Patent applications can be filed for new plants but they need to meet certain requirements to obtain exclusive rights. Varieties are considered:

  • new if on the application filing date they have not been on the market for more than one year in the country in question (and at least four years in any other country – six for trees and vines);
  • distinctive if they clearly differ from all other known varieties;
  • uniform if their significant and relevant characteristics are consistent from plant to plant;
  • stable if their significant and relevant characteristics remain the same from generation to generation, or after cycles of reproduction.
